| The hirer hereby hires the vehicle from Mindarie Car Hire on the following Terms and Conditions. The agreement comprises all documents issued to the hirer at the commencement of the hire plus any additions or deletions to the contract contracted by text, email or given verbally to our staff. HIRER The Hirer warrants to Mindarie Car hire that; both they and all persons that have been listed as ‘persons insured to drive’ on the hire agreement hold a current motor vehicle license valid in Western Australia. This includes any additional drivers added to the Rental Agreement that have not signed the original Rental Agreement. Learner drivers are not permitted to hire or drive. All particulars stated on the hire agreement document are correct. It is upon reliance on truth of all representations made by the hirer that Mindarie Car Hire has entered into this agreement. The hirer accepts that Mindarie Car Hire retains the right to hold all documents relative to the hire for a period of 7 years post completion of the hire. HIRE AND RETURN OF THE VEHICLE The vehicle is hired for the period stated in the hire agreement and no refund is payable for early return or cancellation of the hire. Further extensions of the hire may be agreed, subject to availability of the vehicle and any extensions granted are subject to these terms and conditions. Payment for any contract extensions must be made prior to the extension period to retain the insurance cover for the hirer. Late return of the vehicle incurs an additional charge of $100 plus the daily contracted rate for each day or part day of non-return. The hirer will also be charged with unlawful possession of the vehicle and reported to the police and subject to further action – criminal, civil or otherwise as deemed necessary and lawful should the vehicle not be returned at the end of the agreement. Fuel charges will apply for any vehicle not returned with a full tank or the specified amount of fuel in the vehicle when hired. KILOMETRE ALLOWANCES AND INSURED AREAS TO DRIVE The hirer hires the vehicle with an accepted allowance of kms and driving area as stated on the contract. Should the vehicle be driven out of its contracted area of use a fee of $199 is applicable. Excess kms will be charged at the quoted rate. Driving outside of specified areas renders the hirer to be uninsured and have no roadside assistance cover. The hirer will be liable for all costs should any accident, damage or breakdown occur to the vehicle, including towing of the vehicle back to our Clarkson depot. In addition to this charge any older model, metro use only vehicles found to have driven outside of the 90KMS radius of Perth CBD will also incur a recalculation of the daily rate charged from older model rates to new model rates for the applicable size of vehicle. DRIVING THE VEHICLE The vehicle must not be used to tow any other vehicle, for racing or testing purposes, for the conveyance of passengers or products/produce (e.g. Food Deliveries) for hire or reward or for any illegal purpose or for a purpose other than which it is designed and constructed for. The vehicle must only be driven on sealed tarmacadam or concrete roads. No off-road driving is permitted. The vehicle must only be driven by the hirer and any other named driver signed and acknowledged on the hire agreement. All drivers must be over the age of 21. The vehicle shall not be driven by anyone under the influence of liquor (Alcohol) or drugs. The vehicle must only be used to carry the maximum number of passengers stated by the manufacturer for the vehicle model.. The vehicle must also not be used to carry any dangerous goods, flammable items or explosive items or items of a corrosive nature. The vehicle must be driven in a safe and lawful way. The hirer is responsible for all parking and traffic violations and must report any infringements to Mindarie Car Hire. The hirer shall take all reasonable care in driving, parking and handling the vehicle. The vehicle shall not be driven if it is in any way unsafe or damaged to impair its road worthiness. The hirer shall always lock the vehicle when parked and leave in as safe and secure a place as practically possible. The vehicle cannot be used for taking a driving test. GENERAL CONDITION AND UPKEEP OF THE VEHICLE The hirer is responsible for general safety checks of the vehicle -oil and water daily and general cleanliness and tidiness of the vehicle. Additional charges will be made for any vehicle found to be in an unacceptable condition during the hire or upon return. Vehicles returned with reticulation or bore water damage will incur a $250 cleaning fee. Smoking, vaping or E Cigarettes and the installation of any air fresheners into the vehicle is not permitted. Any evidence of this will incur a $400 detailing and cleansing charge. EARLY TERMINATION Mindarie Car Hire may terminate this agreement and without notice repossess the vehicle should we believe the hirer to be in breach of any term, condition or warranty contained in this agreement with no refund of any charges to the hirer. This includes high level speeding likely to endanger other road users and any evidence of smoking, vaping, drugs or drug taking paraphernalia in the vehicle. Mindarie Car Hire may also terminate the hire and remotely immobilise the vehicle should we have evidence from our tracking systems of antisocial driving or any vehicle movements relating to potential criminal or illegal activity particularly between the hours of Midnight and 5am but also not limited to these hours. BREAKDOWN ACCIDENTS DAMAGE & INSURANCE & INSURANCE EXCESS LIABILITY PAYMENTS The hirer shall be responsible for any damage caused during the rental period including any damage which was not apparent or missed on the day of return of the vehicle so long as the hirer is informed of such damage within 36 hours by Mindarie Car Hire. Payment for this damage is to be made in cash or by debit to the hirer’s credit card at the time of reporting the incident. Mindarie Car Hire is not responsible or liable for the loss or damage to any personal property left in, stolen from or damaged in the vehicle during the hire. The hirer shall not make any claim against Mindarie Car Hire for any personal injuries, inconvenience or damage or delay or any other matter as a result of vehicle breakdown, mechanical, incidental or accident. The hirer shall immediately inform Mindarie Car Hire of any damage to the vehicle and any accident with another vehicle, person or object and complete an accident form and bring the vehicle to Mindarie Car Hire within 24 hours of the incident. The hirer shall give full cooperation and assistance without cost to Mindarie Car Hire in investigating any such accident or damage. In the event of any damage, accident or claim the hirer shall be liable for all costs arising from the damage / accident but the excess stated on the agreement shall apply, the stated excesses are relative to each individual accident and / or item of damage to the vehicle. The hirer’s excess liability as stated shall not apply when the hirer has not completed an accident claim form and attended our office with the vehicle within 24 hours of the incident or been negligent or found to be in breach of any term, condition or warranty of this agreement or the vehicle was driven during the hire period by an unauthorized driver or a driver without a valid license. The full cost of all repairs is then applicable and the hirer’s insurance cover for at fault accidents/ damage is cancelled and the hirer is responsible for dealing with and paying all costs to any third party. The hirer will not allow the vehicle to be repaired or altered in any way without prior authorization from Mindarie Car Hire. Repairs may only be carried out at Mindarie Car Hire’s authorized list of repairers. The hirer will obtain all relevant details for any other vehicles and/or persons involved in the accident including registration numbers, insurance details, names of drivers, driver’s license details and witnesses with full address and telephone numbers. If all details are not obtained the hirer is liable for the total cost of all repairs. In the event of having to tow the vehicle please call our specified towing contractor as detailed in the rental documents Towing is not covered by our RAC breakdown service. The hirer will be liable for all towing costs should they allow the vehicle to be towed by a contractor not approved by Mindarie Car Hire. Damage to the vehicle due to driver error such as filling with incorrect fuel type or driving through water or on beaches or off roading incurs full repair costs and not limited to the excess liability levels stated on the agreement. Tyre and windscreen / glass repair /replacement is classed as damage to the vehicle and the stated excess liability will apply. Replacement vehicles required due to any damage or accidents are subject to availability and a different size/type of vehicle can be supplied at our discretion. No replacement vehicle can be supplied without payment in full or an agreed payment plan for the contracted insurance excess liability. FINANCIAL OBLIGATIONS AND PAYMENTS The hirer and all drivers are jointly and severally responsible and liable under this agreement. The hirer agrees that all hire charges, damage costs, liability costs and any other charges under this agreement are payable upon demand and agrees that the bond deposited with Mindarie Car Hire may be used by Mindarie Car Hire as payment towards ultimate liability. Furthermore, the hirer authorizes Mindarie Car Hire to debit the hirers credit or debit card for any amounts outstanding in respect of this agreement including other costs for debt collection, dishonored payments and all legal and court fees. ADDITIONAL CHARGES & CALCULATIONS Administration and cost of parts charges apply for the following items: Parking/Traffic violations and fines – Cost of infringement plus administration fee of $60. For each vehicle accident/damage claim, regardless of fault – administration fee of $350 is applicable. Unauthorized or unlicensed drivers that are found to have driven the vehicle during the hire period will incur a charge of $250 payable by the hirer. Cost to repossess the vehicle in the case of any default during the contract or non-return of the vehicle is $300 plus key replacement and coding. Late payment of any hire fees is $60 per day per late payment to a maximum of 3 days at which point the vehicle may be repossessed and repossession charges will be incurred. Should the vehicle’s odometer have been tampered with or broken then for the purpose of calculating the distance charge the daily distance will be warranted by the hirer as being 500 kilometers per day. RETURN OF BOND Mindarie Car Hire will refund the bond taken for the hire within 48 hours of the end of the hire as long as there is no damage to the vehicle, and we have no recorded outstanding infringement notices or suspicion of pending notices due to poor driving or excessive speeding in the vehicle. Suspicion of excessive speeding entitles Mindarie Car Hire to withhold bond payments for 28 days. Please note that bond payments can take 3-5 business days to credit back to the payment card due to banking systems which are out of our control. THE PRIZE The winner will receive a Mindarie Car Hire rental voucher valued at AUD $270, based on the cost of a three-day Haval Jolion rental during the off-season period. The voucher may be redeemed towards any vehicle, subject to availability. The winner may choose a longer rental period and apply the $270 voucher towards the total rental cost. Any amount exceeding the voucher value is payable by the winner. The voucher is valid for rentals from 01 March 2027 to 01 September 2027. It cannot be exchanged for cash. Standard rental conditions, driver eligibility requirements and the applicable refundable security bond apply. The winner must identify the booking as a competition prize redemption when arranging the rental. COLLECTION AND RETURN Collection and return can be done at Mindarie Car Hire, Clarkson during our operating hours. Airport, home or other delivery and collection services are excluded from the prize and may be arranged at the winner’s expense, subject to availability. RENTAL REQUIREMENTS AND SECURITY BOND The nominated driver must present a valid driver’s licence accepted by Mindarie Car Hire, provide any required identification and sign the rental agreement before collecting the vehicle. The standard refundable security bond applies. INCLUSIONS AND ADDITIONAL COSTS The prize includes the vehicle hire charge and the standard insurance cover and kilometre allowance applicable to the prize booking. These details, including the insurance excess, will be disclosed before booking confirmation. The prize does not include fuel, optional insurance excess reduction, additional kilometres, optional equipment, tolls, fines, damage charges or other costs arising under the rental agreement. Any rental extension is subject to approval and availability and is payable by the winner at the agreed rate. WINNER SELECTION One winner will be selected at random from all valid entries on Monday 18 January 2027.
